I don't know about maritime law, I do know about land based criminal law. If you are aware of, or should of been aware of a hazard or whatever that could injure or kill others and you have a responsibility for those others it is either a reckless or negligent act and is called manslaughter. If a member of my family had been killed in that incident he would suffer the consequences in court or elsewhere.
