From my boat repair friend Jim:

fluid should always be checked with the motor in the full up position,
mostly because its easier and safer, as its a closed system, theres just as much oil on one side of the piston as there is on the other,and the level really dosent change,
besides on a johnson, you cant get to the screw to check it with the motor down,lol some yamahas and mercs you can though,
