"Things can't get worse"
Didn't live here!!! First I get disabled, Then lose everything, I mean everything! Now on dialysis, and I can't pay my bills. Now my wife got rushed to the emergency room while I was at a treatment, seems her leg has been hurting for a few days and it turned blue. Well she has had 7 bi-passes in her legs in the past. Guess what happened is that she got not one but 5 blood clots and they needed to do surgery. But to make things worse is that cause of all the bi passes she has no vains left, so when her heart went bad they had to put in 5 cardic stents instead of a bi pass. doc says this is high risk cause if anything happens there is nothing that they can do to save her! To make it even more fun her doc is out of state and his partner broke his hand, so there is not another surgen in this area so they rushed her to Boston.
Good news is that after a 5 hour surgery they got it and the leg pinked right up and she will be fine, they say. She is still there in ICU but stable! But now she wants me to go vist, I am lucky to have gas to get to dialysis let alone to boston.
Heat running out, gas running out, not paid car ins, rent behind a month, now this on top. I am about ready to cry, not that I haven't already!!
they say God won't give you anything you can't handle, well he is trying with me!!
Ok rant over!

Joe, not that I have much faith in them, but have you tried all the different Government agencies and programs that are designed to help out people that are in situations like you are? I see 3rd and 4th generation minority people who do nothing but live on welfare riding around in nice cars and using food stamps etc. to pay for good food and nice apartments. I know you're not a minority, but it seems to me you should be eligible for some programs.

don't let it get you too far down MJ, what destroyer said X2, i would be nice to see some one who "earned" benefits to actually get them. Check with social services and get a case worker. There's got to be something out there for you, you paid into to it most of your life.
Joe, not sure if you have yet or not, but apply for SSDI. You would definitely be qualified for it. You have paid into it since you started working and now you are entitled. Maybe your wife too.

Thanks Guys, I have tryed for a lot but because my other house is not fourclosed on yet they say I own 2 houses so I don't comply.
That said I have a new app in for SSI and my advocate at dialyssis has given them all they need and they called me the other day and said all set but they take a few months to decide. Advocate said that they will give it but in there own time as there is no deining my disabilty now that I am on dialysis. So I am hoping for sooner then later. My wife is on SSI for 35 years, she is leagly blind, but after wer pay for the mobile park fee we live on $300 a month, it doesn't go far with these pricices today!! the big killer is the oil heat I am going to starve soon if it doesn'get warm , and now another 6"+ tomorrow! MJ, I have been thinking about your house situation, that seems to be the sticking point to you getting the help you are due.
If the bank wont foreclose...why not move back in to that house...you could probably pay a little here and there to the bank and they would never foreclose.
Just thinking out loud.
Good luck to you and all yall Yankees with the storm headed your way.

I know the feeling. I worked when I was able, got hurt, but had money set aside so I lived off of that. Now that I can't work and have filed, I am basically told I'm SOL because I waited to long. I haven't even been able to find an attorney to take my case because they came right out and said I have a case, but it is to much work for them when they are swamped with easy cases. So I know the feeling.

I'm sure everyone buys friends beers, let's buy MJ a few "beers\oil" with that donate button. It's quick and easy.

Jeez Joe, sorry to hear bad things keep on happening but it's got to look up at some point.
My wife had a heart valve replaced a couple years ago and hasn't been the same since and hasn't been able to go back to work and likely never will. We went thru some dire straights financially and at the time a call to my state rep and the state attorney general got me some breathing room and got the mortgage company to get off their butts and do something for me.
Call your state rep and ask their office to call and write the mortgage company. I bet they have a direct line to Joe for Oil too. I'd tell the AG you think you were a victim of predatory lending and you need some relief. I found these two offices did the most for me.
I hope things start to look up for you and Mrs. MJ.
All the best,
Steve

Yep. People are just like horses... let a sick horse lay around and they never get better. Same with people. You must get and keep her moving. It's the
same with machines... actually, it's universally the same with everything.
I know that it's not quite the same thing, but Newtons first law (the law of inertia) applies to all moving things... An item at rest tends to stay at rest. an item in motion tends to stay in motion unless acted upon by an outside force.
Keeping her moving and active actually is speeding up the healing process. Good work!!

Hey Joe, why don't you rent out your house.... Might as well draw from it as long as the bank doesn't take it... then if they finally foreclose, eviction is their problem

A friend of mine went through this on his house. He lost his job when the market fell out, and lost his place. The bank kicked him out, then let him move back in so the house didn't sit vacant. After teh house went to auction 3 times after he was kicked out again, the bank purposely messed up some of the foreclosure papers so the house didn't go to them legally. Then when the property taxes and cleanign fees piled up from the county and city, they turned around and said it wasn't theres but his, and they came after him for over $15K in fees on a house they had forclosed on 2 years before. It is all a game to them, and they are playing it hoping to worm out of liability and fines in case something happens to the house.

By changing the locks they have, in the eyes of the law, taken legal possession of it.

MJ - Why did you ask for a key? That just slowed down the process.

I'm not up to date on this stuff but have you heard of or looked into giving the bank a "deed in lieu of foreclosure" to get rid of the other house? You need to get competent advice on the subject - if there are any active Realtors on the site or if you know one, they might be familiar with the process. Where I am the local Realtor association has a lawyer who gives seminars on that kind of stuff - a Realtor might be able to tell you if it seems like a good idea and maybe get you a little free advice from their lawyer.
Another possible source of help is your federal senator or congressman. A friend of mine was getting jerked around badly by the bank, trying to get his loan modified and one of our senators was very helpful slapping the bank upside their head. If your old lender is dragging their feet, this might be a way to get them moving.
You and your wife are in my prayers and you know you have a bunch of guys here who are on your side and wishing the best for you and your family. I wish I had more concrete help to offer.

Yes, he could change the locks again, but it would be illegal. The difference being that if he were to change the locks, it would be without their permission to do so. When Joe gave them the keys, it was understood that he was giving them control of the property and the ability to legally change the locks. Whereas, by giving Joe the keys, they have implicitly given him permission to visit/enter the premises, but they have not given him control.

Joe, I own 3 houses. I live in one, and rent out the other two. All utilities in the 2 rentals are paid for by the renters. It's understood to be the norm, and is spelled out in the lease. My point being that lack of utilities should not prevent you from renting the house, if you can legally do so.
If the bank has foreclosed on the property, then they are the legal owners of the house, and the only ones that can legally rent it out. Just because a house is not occupied does not mean the bank doesn't want it. Understand, because of the present economic situation in this Country, a lot of banks are just sitting on houses they own right now and are not trying to rent or sell them. They are waiting on the economy to improve so they can get a better return on their investment.
